<p>MAN TO BE ARRAIGNED FOR KILLING PASSENGER AND INJURING TWO OTHERS IN FIERY CRASH AFTER INHALING NITROUS OXIDE GAS WHILE DRIVING</p>
<p>SANTA ANA &#8211; An intoxicated driver was arrested today on charges of killing a passenger in his vehicle and injuring two others after inhaling nitrous oxide gas while driving and crashing his car, causing it to catch on fire. Jose Luis Gomez Nava, 20, Santa Ana, is charged with one felony count of vehicular manslaughter with gross negligence while intoxicated with sentencing enhancements and allegations for causing great bodily injury and causing great bodily injury to more than one victim. If convicted, he faces a maximum sentence of 14 years in state prison. Nava is expected to be arraigned today, Aug. 24, 2011, in Department C-57, Central Justice Center, Santa Ana. The time and defendant&#8217;s bail amount are to be determined.</p>
<p>At approximately 7:40 p.m. on Nov. 20, 2010, Nava is accused of speeding over 80 mph in a 45 mph zone heading southbound on Fairview Street toward MacArthur Boulevard in Santa Ana. Friend Steve Gomez, 15, was riding in the front passenger seat and friends Roman Gomez, 19, and Elvira Orejel, 18, were in the back seat.</p>
<p>Nava is accused of inhaling nitrous oxide gas from balloons while driving. After ingesting the nitrous gas, he is accused of dropping his head and releasing his hands from the steering wheel. Nava is accused of losing control of his vehicle, which went up onto the center median and crashed into a pine tree. The impact of the crash and damage to the front end of the vehicle caused the car to catch fire.</p>
<p>Steve Gomez was trapped inside the vehicle and died at the scene due to multiple blunt force trauma injuries. Orejel had to be extricated from the vehicle by Santa Ana Police Department (SAPD) officers and was transported to the University of California, Irvine (UCI) Medical Center to be treated for a broken leg. Roman Gomez was able to exit the vehicle on his own and was transported to Western Medical Center to be treated for abrasions to his chest and knee.</p>
<p>Nava is accused of being trapped inside his vehicle and had to be extricated by the Santa Ana Fire Department. The defendant was comatose and transported to UCI Medical Center to be treated for severe head and thermal injuries and a broken clavicle.</p>
<p>Nava is accused of being in possession of balloons in his pants pocket. A gas cylinder, valve knob for the gas cylinder, and a balloon were located by responding officers on the center median grass near the crash site.</p>
<p>The Orange County District Attorney&#8217;s Office filed charges against Nava on March 24, 2011. He was arrested today by SAPD after spending several months in medical care for his injuries.</p>
<p>Deputy District Attorney Nancy Hayashida of the Homicide Unit is prosecuting this case.</p>

Sonia Hermosillo, 31, La Habra, is charged with one felony count of attempted murder with premeditation and deliberation and one felony count of child abuse causing great bodily injury. If convicted, she faces a maximum sentence of 15 years to life in state prison. The People will be requesting Hermosillo be held on $1 million bail, and she is also subject to a no-bail Customs and Immigration Enforcement hold. The defendant is expected to be arraigned today, Wednesday, Aug. 24, 2011, in Department CJ-1, Central Jail, Santa Ana. Based on the arraignment process in in Department CJ-1, the time is to be determined and will not be available in advance.</p>
<p>On Aug. 22, 2011, Hermosillo is accused of driving her 7-month-old son, Baby Doe, to the Children&#8217;s Hospital of Orange County (CHOC) and parking her car on the fourth floor of a parking structure. The baby suffered medical conditions that required him to be treated at CHOC regularly, but he did not have a scheduled appointment that day. The victim wore a helmet on his head for one of his medical conditions.</p>
<p>At approximately 6:20 p.m., Hermosillo is accused of removing the victim&#8217;s helmet and pushing her baby from the parking structure with the intention of murdering him with the four-story fall. After attempting to murder Baby Doe, Hermosillo is accused of walking inside the hospital, validating her parking, and fleeing the scene.</p>
<p>A witness who saw the baby falling through the air called 911 and the Orange Police Department (OPD), who is investigating this case, responded to the scene. Baby Doe was transported to the trauma center at the University of California, Irvine Medical Center and remains in critical condition.</p>
<p>OPD obtained a license plate number from a vehicle and matched it to an address in La Habra. The La Habra Police Department (LHPD) and OPD began to communicate and it was determined that Hermosillo&#8217;s husband had just called LHPD to report the defendant and his son missing.</p>
<p>At approximately 10:15 p.m., Hermosillo is accused of driving past CHOC on Main Street and was observed by an OPD officer. She was arrested at the scene.</p>
<p>The defendant is married and has two other children.</p>
<p>Senior Deputy District Attorney Scott Simmons of the Homicide Unit is prosecuting this case.</p>

<p>PAROLE DENIED FOR FEMALE INMATE CONVICTED OF MURDER IN VIOLENT, GANG-MOTIVATED CRIME SPREE</p>
<p>SANTA ANA &#8211; The Board of Parole Hearings, California Department of Corrections and Rehabilitations, denied the parole today for a woman who was convicted of murdering a 16-year-old gang rival in a dangerous and violent crime spree. Gabriella Maldonado, 37, is currently being held at Valley State Prison for Women in Chowchilla, CA. Maldonado was sentenced Jan. 31, 1992, to 25 years and four months to life in state prison after being found guilty in a court trial of one felony count each of second degree murder, second degree robbery, assault with a firearm, shooting at an inhabited dwelling, and shooting at an unoccupied vehicle. The inmate was 16 years old at the time of the crime and was prosecuted as an adult. Maldonado will be eligible for her next parole hearing in 2014.</p>
<p>Senior Deputy District Attorney Mike Murray attended the hearing via video conference to oppose Maldonado&#8217;s parole.</p>
<p>Crime Spree and Murder of Leo Huichocez<br />
On Feb. 12, 1991, then-16-year-old gang member Maldonado set out on a crime spree with her boyfriend, brother, and two friends. With the intention of stealing a car, the inmate approached a teenage couple in a parked Volkswagen pretending to be a passerby and asked for the time. While the couple was responding, the inmate&#8217;s boyfriend appeared and ordered the victims out of the car at gunpoint. Maldonado and her crime partners stole the vehicle and drove into rival gang territory in search of any rival with the intention of retaliating for the vandalism of her family&#8217;s car several days earlier.</p>
<p>The inmate and her crime partners drove past two female pedestrians, whom one of the defendants recognized and disliked due to a previous conflict. Maldonado and her co-defendants demanded to know the gang affiliation of the two female victims before Maldonado&#8217;s boyfriend pointed a firearm at them. The two girls fled. Maldonado and her co-defendant then continued on in the stolen vehicle and shot out the windshield of an unoccupied rival gang member&#8217;s car. The bullet went through the window and a garage before lodging into the wall of a house. The five then fired another shot into a residence with nine people inside where they believed rivals lived.</p>
<p>Minutes later, Maldonado and her crime partners drove past two male teenagers, including 16-year-old Leo Huichocez, who were walking down the street. Maldonado&#8217;s boyfriend shot Huichocez in the face, murdering him. Maldonado was arrested three days later.</p>
<p>Lack of Remorse and Rehabilitation and Threat to Public Safety<br />
In 2010, almost 20 years after her violent, murderous crime spree, Maldonado has yet to accept her guilt or responsibility for what she did. She maintains, &#8220;.I was just there.&#8221; This statement demonstrates a lack of remorse and true insight into her involvement in the crime, which was gang-motivated and lacked any respect for human life.</p>
<p>Since her incarceration, Maldonado has had an exceptionally poor disciplinary history. She has accumulated 11 major rules violations, three of which were violent, including mutual combat requiring the use of force, mutual combat, behavior which could lead to violence, conspiracy to introduce heroin and cocaine for distribution, disobeying direct orders, altering currency, failing to return to a job assignment, possession and use of a controlled substance, and kissing another inmate. Maldonado has also accumulated 42 additional violations, the most recent in December 2010, including but not limited to failing to report on time, failure to report to testing, failure to report to a job, behaving in a manner designed to encourage sexual acts, and other conduct violations.</p>
<p>The inmate continues to display a lack of rehabilitation and proves she cannot remain violence-free or follow rules even while incarcerated, in a structured environment, and with the knowledge that disciplinary action will hinder her ability to be free.</p>
<p>Maldonado&#8217;s clear lack of rehabilitation, ongoing prison rules violations, and lack of remorse and true insight into her crime, demonstrate that the inmate continues to pose an unreasonable risk of danger to society and should not be released.</p>

<p>CHARGES UPGRADED TO MURDER AGAINST DRUNKEN TEEN DRIVER FOR KILLING FATHER AND SON IN HIGH-SPEED EARLY-MORNING CRASH</p>
<p>SANTA ANA &#8211; An amended complaint was filed today based on the findings of the ongoing investigation upgrading charges to two felony counts of murder against a drunken teenage driver for killing a father and son in an early-morning high-speed crash. Rafael Lopez, 19, Anaheim, now faces a maximum sentence of 30 years to life in state prison if convicted. Lopez was previously charged Dec. 21, 2010, with two felony counts of vehicular manslaughter. He is being held on $1 million bail and is scheduled for a continued arraignment Oct. 3, 2011, at 9:00 a.m. in Department C-5, Central Justice Center, Santa Ana.</p>
<p>At approximately 5:30 a.m. on Dec. 18, 2010, Lopez is accused of driving at a high rate of speed while under the influence of alcohol on Crescent Avenue in Buena Park. He is accused of driving his Mitsubishi sedan at a speed approximately twice the 45 miles per hour speed limit, accelerating through the red light at the intersection of Knott Avenue and Crescent Avenue, and failing to brake before crashing into a Buick sedan driven by 44-year-old Steven Uselton. Steven Uselton&#8217;s 17-year-old son Douglas Uselton was riding in the passenger seat, as his father was driving him to an early-morning high school debate tournament.</p>
<p>Lopez is accused of causing the victims&#8217; car to travel over 130 feet before coming to a stop as a result of the high-speed impact. Steven and Douglas Uselton were both pronounced dead at the scene. Lopez is accused of murdering Douglas Uselton by causing blunt force trauma to the head and internal injuries. Lopez is accused of murdering Steven Uselton by causing multiple blunt force injuries and internal bleeding.</p>
<p>Lopez is accused of having a .13 blood alcohol level. He was transported from the scene to the hospital to be treated for minor injuries and was arrested by the Buena Park Police Department (BPPD) upon being discharged.</p>
<p>The victims are survived by a wife/mother and a teenage daughter/sister.</p>
<p>BPPD investigated this case and Senior Deputy District Attorney Alison Gyves of the Homicide Unit is prosecuting this case.</p>

<p>MAN CONVICTED OF RAPING THREE WOMEN, TWO OF WHOM HE MET ON MYSPACE</p>
<p>FULLERTON &#8211; A Yorba Linda man was convicted today of raping three women, two of whom he met on MySpace. Jason Ara Erpinar, 22, pleaded guilty today to two felony counts of rape by intoxication and one felony count of forcible rape. He is expected to be sentenced to 15 years in state prison at his sentencing Wednesday, Aug. 24, 2011, at 3:30 p.m. in Department N-13, North Justice Center, Fullerton. Some of the victims in this case are expected to give victim impact statements at the sentencing hearing.</p>
<p>On March 26, 2008, Erpinar invited 22-year-old Jane Doe #2 on a date after meeting her on the social networking website, MySpace. He went with the victim to two Orange County parks and consumed alcohol with her, and the victim became severely intoxicated. Erpinar drove Jane Doe #2 to a Newport Beach hotel and raped her while she was unable to resist due to alcohol intoxication. When Jane Doe #2 woke up the following morning, she had a cracked tooth and several scrapes to her face. The victim went to the hospital and reported the case to the Newport Beach Police Department. A criminal case could not be filed due to a lack of sufficient evidence at that time.</p>
<p>Erpinar met 18-year-old Jane Doe #1 on MySpace. He contacted the victim by phone and e-mail and invited her to a house party in La Habra on March 7, 2009. At the party, Jane Doe #1 became severely intoxicated due to alcohol consumption and began to vomit. Erpinar raped her on the floor of a bedroom while she was unable to resist due to alcohol intoxication. Jane Doe #1 reported the rape the next day to the La Habra Police Department (LHPD).</p>
<p>During the investigation by LHPD, Erpinar&#8217;s ex-girlfriend, Jane Doe #3, was contacted. Erpinar was physically abusive toward Jane Doe #3 while they were in a dating relationship when she was 17 years old. Between August 2006 and October 2007, he forcibly raped her.</p>
<p>The three victims do not know each other.</p>
<p>Deputy District Attorney Mark Birney of the Sexual Assault Unit is prosecuting this case.</p>

<p>DMV EMPLOYEE CHARGED WITH ACCEPTING MONEY IN EXCHANGE FOR FALSIFYING OFFICIAL RECORDS FOR COMMERCIAL DRIVER&#8217;S LICENSES</p>
<p>SANTA ANA &#8211; An employee of the California Department of Motor Vehicles (DMV) has been charged with altering driver&#8217;s license records and issuing commercial licenses to individuals who had not passed the required written and driving tests in exchange for money. Michelle Carbajal, 37, Fullerton, is charged with 19 felony counts of altering public documents and 19 felony counts of computer access and fraud. If convicted, she faces a maximum sentence of 22 years in state prison. She is being held on $100,000 bail and is expected to be arraigned Monday, Aug. 22, 2011, in Department CJ-1, Central Jail, Santa Ana. The time is to be determined.</p>
<p>Carbajal was an employee at the Fullerton office of the DMV and is accused of having access to and the ability to alter driver&#8217;s license records through her work.</p>
<p>Between June 10, 2009, and April 27, 2010, Carbajal is accused of accepting money from 12 individuals in exchange for unlawfully altering their driver&#8217;s license records. She is accused marking in the records of the 12 individuals that they had passed both the written and driving tests to obtain a commercial license. Some of these tests were safety-related including proper use of specialized brakes, proper pulling of double trailers, the ability to drive semi-trucks and other commercial vehicles, among other skills. None of the 12 individuals had passed any of the tests.</p>
<p>In some instances, Carbajal is accused of altering the records on one day and in other cases she is accused of altering the records on multiple days. After altering the records to falsely represent that the tests had been passed, Carbajal is accused of issuing commercial licenses to the 12 individuals.</p>
<p>She is accused of altering the records for these 12 individuals, who were referred to her through a third party or parties, who are unidentified at this time. In all, the 12 purchasers paid $23,000. It is unclear at this time how much Carbajal fraudulently accepted and how much was paid to the unidentified third party/parties.</p>
<p>The DMV Investigation Division began investigating this case after her supervisor become suspicious of her conduct at work. The DMV then turned over their investigative findings to the Orange County District Attorney&#8217;s Office (OCDA). Carbajal was arrested today, Aug. 19, 2011, by DMV investigators.</p>
<p>The investigation is ongoing. Anyone with information related to the identity or identities of the unidentified third party/parties is encouraged to leave a message on the OCDA&#8217;s Special Investigations Hotline at (714) 347-8544.</p>
<p>Deputy District Attorney Brock Zimmon of the Special Prosecutions Unit is prosecuting this case.</p>

<p>MAN SENTENCED TO SIX YEARS AND FOUR MONTHS IN PRISON FOR HATE CRIME ARSON FOR SETTING CHURCH PROPERTY ON FIRE AFTER BECOMING DISGRUNTLED WITH ITS TEACHINGS AGAINST MASTURBATION</p>
<p>SANTA ANA &#8211; A man was sentenced today to six years and four months in state prison for committing hate crime arson by lighting three fires at an Irvine church and attempting to set the church on fire because he was disgruntled with the church&#8217;s teachings regarding masturbation. Izad Chavoshan, 32, Huntington Beach, pleaded guilty to the court Aug. 9, 2011, to three felony counts of arson, one felony count of attempted arson, and a hate crime sentencing enhancement. The defendant has a prior strike conviction for criminal threats in 1998.</p>
<p>On three separate nights between Oct. 15, 2009, and Oct. 19, 2009, Chavoshan drove to the Orange County Church of Christ in Irvine after everyone had left. The defendant, a former church member, disagreed with the church and its teachings against masturbation. On all three occasions, the defendant moved trash cans to the front of the church and set the contents on fire. Church employees reported the fires to Irvine police, who began investigating the case.</p>
<p>At approximately 10:00 p.m. on Oct. 21, 2009, Chavoshan drove to the church and parked close to the front doors. He approached the front of the church and repeatedly threw a trash can at the glass portion of the front doors in an effort to break the glass. The defendant then removed a pack of matches from his pocket, lit a piece of paper on fire, and attempted to set the church on fire by pushing the lit piece of paper between the closed church doors.</p>
<p>Chavoshan was arrested at the scene by officers, who had been monitoring the church in response to the three trash can arsons. This case was investigated by the Irvine Police Department Special Investigations Unit and Orange County Fire Authority fire investigators.</p>
<p>Deputy District Attorney Andrew Katz of the Special Prosecutions Unit prosecuted this case.</p>

<p>PAROLE HEARING FOR INMATE CONVICTED OF MURDER FOR STABBING AND BEATING GAS STATION EMPLOYEE CONTINUED TO 2016</p>
<p>SANTA ANA &#8211; The Board of Parole Hearings, California Department of Corrections and Rehabilitations continued the parole hearing today to 2016 for an inmate convicted of murdering a gas station employee by stabbing and beating him to death. Miguel Rodriguez, 39, was sentenced Dec. 4, 1991, to 15 years to life in state prison after pleading guilty to one felony count of second degree murder. This case was originally prosecuted by former Deputy District Attorney Jeoffrey L. Robinson. He is currently being held at Centinela State Prison in Imperial, CA, and was scheduled for a parole hearing today. Prior to the hearing, Rodriguez conceded that his parole would be denied based on his recent disciplinary history while incarcerated and stipulated to a 5-year continuance. Senior Deputy District Attorney Rebecca Olivieri was present to oppose Rodriguez&#8217;s parole.</p>
<p>Murder of Harold Doorenbos<br />
At approximately 2:00 a.m. on Aug. 12, 1991, Rodriguez, then-19 years old, and two other co-defendants entered an Anaheim gas station on Ball Road and State College Boulevard, with the intent to assault the gas station clerk on duty. Rodriguez and one of his co-defendants worked at the gas station and were angry with the clerk for complaining about them to their boss. The three defendants waited until customers had left the gas station and they were alone with 47-year-old gas station employee, Harold Doorenbos. The victim was a father of five children who worked two jobs to support his family.</p>
<p>The defendants took Doorenbos by surprise and brutally beat him. They stabbed him multiple times in the back and left side of his chest and struck him repeatedly in the head with a blunt object, smashing his head and teeth and leaving his face deformed. The three men left the murdered victim and fled the scene, taking money from the cash register and safe. They were questioned by Anaheim police and arrested eight days later.</p>
<p>Lack of Rehabilitation and Threat to Public Safety<br />
Since his incarceration, Rodriguez has accumulated 25 prison rules violations, three of which he recently received since his last parole hearing in September 2007. Two of them were in April 2011 for battery on an inmate and fighting and he also battered an inmate in 2008. Rodriguez has also been disciplined for other major prison rules violations including inmate manufactured alcohol, battery on an inmate, failure to follow instructions, possession of a controlled substance, disobeying a direct order, and hiding out with the attempt to escape. The inmate has continued to display a lack of rehabilitation, proving he cannot remain violence-free, even when he is incarcerated and knowing it will hinder his ability to be free.</p>
<p>Considering the inmate&#8217;s lack of rehabilitation and his ongoing major prison rules violations, the inmate poses a danger to the community.</p>
